**Public Offer Agreement for the Use of the Feedspy.net Program (Site)**
This User Agreement (hereinafter referred to as the Agreement) is a public offer contract regulating civil-legal relations between the individual entrepreneur Niftaliev, represented by the Feedspy.net site (hereinafter referred to as the Service, Feedspy), and individuals and legal entities (hereinafter referred to as the User) as users of the service in accordance with Article 395 of the Civil Code of the Republic of Kazakhstan. The Agreement is fully and unconditionally accepted by the User when using the available features and performing available actions on the service. The Service reserves the right to change this Agreement without notifying the User.
**1. Terms and Definitions**
In this User Agreement, the following terms are used with the following meanings:
- **Feedspy.net/ or Service**: An Internet resource located on the World Wide Web, representing a set of data and commands, source code, database, graphical interface design, etc. Access to the Service is provided through any user devices via a browser (software for viewing web pages) at https://feedspy.net/.
- **User**: An individual or legal entity using and visiting Internet resources, including Feedspy.net.
- **Registration**: Actions taken by the User aimed at providing user account data and obtaining access to the Service. Registration is done through provided social networks.
- **Tariff Plans**: A list of prices depending on the period of use of the Service and the number of social networks.
**2. General Provisions. Access to the Service**
**2.1.** Based on this Agreement, the Service offers the User the following features: registration, searching for pages, communities, groups, and people on social networks, as well as their analytics, etc. Feedspy has the right to set additional conditions, rules, and restrictions, make changes, adjust, expand the capabilities of the Service, and change the terms of User access.
**2.2.** The User has the right to use the service according to the Tariff Plans for any period chosen by the User as a prepayment in full.
**2.3.** Payment is made cashlessly using the methods offered on the Service. The Service reserves the right to add and remove payment methods without prior notice to the User.
**2.4.** Registration on the Service is carried out through social network authorization. The Service is not responsible for the security of the User's personal data.
**2.5.** The operation of the Service depends on the operation of social networks: access, functionality, and limitations. The Service is not responsible for problems arising in connection with the operation of social networks, namely technical limitations, changes, or problems of the following sites: facebook.com, vk.com, ok.ru, instagram.com, twitter.com, youtube.com, pinterest.com, telegram.org.
**2.6.** The Service is not responsible for the operation of third-party software used by the User.
**2.7.** The use of the Service by the User implies the User's complete agreement with the Agreement and acceptance of responsibility for actions on the Service.
**2.8.** The features provided on Feedspy can be changed, supplemented, updated, and modified at any time without prior notice to the User, and their use is offered as-is at the time of the User's access to the Service. Feedspy has the right, at its discretion, to terminate (temporarily or permanently) the provision of the Service (or any individual functions within the Service) to all Users in general or to an individual User, in particular, without prior notice.
**3. Rights and Obligations of the Parties**
**3.1.** The Service does not guarantee that the software of the Service is error-free and/or free of computer viruses or foreign code fragments. The Service does not provide any guarantees of operability and is not responsible for malfunctions on the User's side.
**3.2.** The User is responsible for actions performed on the Service in accordance with the current legislation of the Republic of Kazakhstan.
**3.3.** Feedspy is a tool that enables Users to analyze information from social networks. Consequently, the Service is not responsible for the content, distortion, or loss of information provided by social networks.
**3.4.** The Service reserves the right to suspend the operation of the Service for technical and preventive maintenance at any time.
**3.5.** The Service is not responsible for any claims made by the User if the User's expectations regarding the qualities and capabilities of the Service are not met.
**3.6.** The User has the right to use the functional capabilities of the Service according to the Tariff Plan.
**3.7.** The operation of the Service is carried out by executing scripts in the User's Browser.
**3.8.** The User is prohibited, and no provision of this Agreement shall be interpreted as granting the User the right to:
- a) Modify, decompile, disassemble, decrypt, and perform other actions with the object code specified in this Agreement.
- b) Copy the source code of the Service.
- c) Distribute, disclose the Service (in whole or in part), rights to which are transferred under this Agreement, i.e., provide direct or indirect access to the Service (or its components), reproduced in any material form and by any means, including network or other methods, as well as by selling, leasing, lending, including importing for any of these purposes, or when providing any kind of services (performing work) under contracts with third parties with direct or indirect use.
- d) Perform other actions aimed at deriving commercial benefit in relationships with third parties from using the Service.
- e) Grant sublicenses for any use of the Service or its parts to third parties.
- f) Attempt to gain access to other Users' data.
- g) Attempt to mislead and bypass the technical limitations of the Service.
**3.9.** It is prohibited to offer services related to the use of the Service to other Users for profit. It is prohibited to use any automatic scripts ("robot programs") or other means that allow interaction with the Service without the User's participation. It is prohibited to perform actions aimed at disrupting the normal functioning of the Service or to use special programs containing malicious components ("viruses"). It is prohibited to work on the Service simultaneously from different devices or to work simultaneously in two or more tabs.
**3.10.** It is prohibited to transfer account access to other Users or for two Users to work from one account.
**4. Copyrights and Trademarks**
**4.1.** The Site is protected by the legislation of the Republic of Kazakhstan on intellectual property and international law norms. All exclusive rights to the Service, its accompanying materials, and any copies thereof belong to Feedspy.
**4.2.** The Service does not hold copyrights for materials uploaded through the site’s program interface from social networks but only provides the ability to view them.
**4.3.** The algorithms of the Service and its source codes, including their parts, are commercial secrets of the Service. Any use of them or the Service in violation of the terms of this Agreement is considered a violation of the rights of the Service and is sufficient grounds for the revocation of the rights granted under this Agreement and unilateral termination of the agreement.
**4.4.** Liability for violating the Service's copyrights arises in accordance with the current legislation of the Republic of Kazakhstan.
**4.5.** This Agreement does not grant the User rights to use Trademarks and Service Marks of the Service and/or its partners.
**4.6.** This Agreement is governed by and construed in accordance with the laws of the Republic of Kazakhstan. Issues not regulated by this Agreement shall be resolved in accordance with the applicable laws. All possible disputes arising from relationships regulated by this Agreement shall be resolved in accordance with the procedure established by law, under the norms of the law of the Republic of Kazakhstan.
**5. Affiliate Program**
**5.1.** By registering with the Service, the User thereby certifies that they have read this Agreement and agree to its terms.
**5.2.** To participate in the affiliate program, the User must know:
- The terms of the affiliate agreement and all its attachments.
- Affiliate rewards are accrued for the first payment of any tariff on the site https://feedspy.net.
- The affiliate receives a reward after the client fully pays the chosen tariff.
- If the client refunds the paid funds, the affiliate's reward from this payment is deducted.
**5.3.** To withdraw earned funds, a request must be sent to the email address support@feedspy.net indicating the affiliate link in the email.
**5.4.** Money earned through the affiliate program can be used for full or partial payment of a tariff on the site https://feedspy.net for personal use, friends, or colleagues, as well as withdrawn through payment systems WebMoney, Yandex.Money.
**5.5.** The minimum withdrawal amount is 200 rubles.
**5.6.** Affiliate rewards are not accrued to partners who violate the rules of the affiliate program. The decision on rule violations is made by the Service administration without notifying the partner.
**5.7.** If the partnership is terminated at the partner's initiative, the administration of the site https://feedspy.net reserves the right to block the partner's account and terminate the partnership without paying out the remaining funds on the account.
**5.8.** All advertising channels and tools of the partner must not contain information that contradicts the laws of the Republic of Kazakhstan or illegal materials, namely: violating copyrights and related rights, trademark rights, patent, and other intellectual property rights. The partner is fully responsible for violations of the current legislation of the Republic of Kazakhstan, copyright, and related rights on their platforms.
**5.9.** It is prohibited to mislead clients and users of the affiliate program. The partner has the right to attract clients only on their behalf, without creating internet platforms that duplicate the main site and representations of the Feedspy.net Service in social networks.
**5.10.** The promotion of all referral links through SPAM and other illegal methods not in compliance with the current advertising legislation requirements is prohibited. The Feedspy.net Service does not participate in the distribution of SPAM, and all partners are expected to follow this rule. Violation of this rule will lead to the annulment of this Agreement and the immediate removal of the partner from the affiliate program; no commissions will be paid.
**5.11.** The Feedspy Service is not responsible for any losses (including loss of income or information) incurred in connection with participation in this affiliate program.
**5.12.** The Partner must not share their login and password with third parties, which provide access to the personal account and other services provided by the affiliate program. All actions requiring the use of a login and password are considered to be performed by the Partner. The Service is not responsible for the security of the Partner's data.
**5.13.** It is prohibited to use contextual advertising on brand queries as a means of promoting the feedspy.net site.
**5.14.** Allowed types of traffic:
- Contextual advertising (not on the brand);
- Social networks;
- Retargeting;
- Content projects;
- Banner advertising;
- Teaser advertising;
- Email newsletters (after approval).
**6. Miscellaneous**
**6.1.** This User Agreement comes into force from the moment the User starts using the Service, regardless of the fact of the User's Registration, and is valid indefinitely.
**6.2.** The Service reserves the right, at its discretion, to terminate the access of a User who violates this User Agreement.
